We have been getting some questions like:
“Can I still send the documents even though it is past December 1st”
“Is there a problem if I did not get the 4th and 5th notice sent back before the 1st”
Great questions! So let’s take a look at this a bit.
First thing you might want to think about: Does a Fraud expire because the party wanting to commit the Fraud or trick you into giving them consent to commit the fraud makes a ‘deadline’? No
Does an Omission of Fact expire because the injuring party says so? No
Does a Fatal Defect disappear because of a calendar date? No
Perhaps you may have been asking yourself:
“What is a Fatal Defect anyway”
Let’s take a look at the legal definition:
So we see that common sense tells us they can’t just set a ‘deadline’ and send piles of ‘Notices’ with stop watches on the envelope or BIG RED letters etc. and make all the above mentioned go away.
Sure, they can physically mail you notices saying this (Not By Registered Mail) or call you and say ‘you have no choice after X day’ but does that make the facts go away?
Now, let’s look at the Notices you have sent or will send, from the BC Freedom site.
Note: THIS IS TAKEN FROM THE BC BUSINESS PRACTICES AND CONSUMER PROTECTION ACT.
So the law itself makes it pretty clear that BC Hydro cannot just set a ‘deadline’ which allows their fraud to be ‘legal’ or the Fatal Defects to be ‘ok’ etc. Considering the documents contained have a few ‘unconscionable’ acts or practices they want to push you into at a future date in/on them.
To summarize, you most certainly can still do the documents.
You can ABSOLUTELY do the documents if you signed the ‘Meter Choices Program’ Notice and mailed it back thinking there was no other ‘choice’.
You can definitely still send back the 4th and 5th Notices *After you have done documents at the site and followed all directions at the site for the group you are in* CLICK HERE
